These Terms of Service ("Terms") govern your use of the Modern Websites website and, if you sign up, the website design, build, hosting, and support service we provide (the "Service"). By using our site or subscribing to the Service, you agree to these Terms.
We have written these Terms in plain English because we want you to actually read them. If anything is unclear, ask us before you sign up — we would rather answer questions up front than surprise you later.
The Service
Modern Websites is a productized website service for contractors. For a flat $250 per month, we provide:
- Design and build of a professional website for your business.
- Hosting and an SSL certificate.
- On-page SEO setup (page titles, descriptions, headings, and basic technical hygiene).
- Ongoing edits and support as described in the Scope of Ongoing Edits section below.
- Setup of Google Workspace email on your own domain. The Google Workspace subscription itself is between you and Google and is billed by Google directly — it is not included in the $250 monthly fee.
You keep ownership of your own domain name at all times. If you do not have a domain yet, we will help you register one in your name, with your registrar account.
How an Engagement Works
A typical engagement follows three steps:
- Demo call. We meet to review your business, show you what we do, and confirm the Service is a fit.
- Build. After you sign up and provide your content, we design and build your site, targeting completion within 7 days of receiving what we need from you. Build timelines depend on receiving your content and feedback promptly; delays on your side extend the timeline correspondingly.
- Launch. We review the finished site with you, make agreed adjustments, and take it live on your domain.
Your Responsibilities
To build and maintain your site, we need your cooperation. You agree to:
- Provide accurate information about your business, services, licensing, and credentials. We publish what you give us; you are responsible for its accuracy and for compliance with any rules that apply to advertising in your trade.
- Provide photos, logos, and other materials that you own or have the right to use. Do not send us images pulled from the internet, other contractors' sites, or manufacturers' materials unless you have permission to use them.
- Respond to our requests for content, feedback, and approvals in a reasonable time.
- Maintain control of your own domain registrar account and, once set up, your Google Workspace account, including their login credentials and billing.
Content You Provide
You keep ownership of everything you give us — your logo, photos, text, and business information. You grant us a license to use those materials to build, host, display, and promote your website while you are a client, and to show the finished site in our portfolio and marketing (tell us in writing if you prefer we not feature your site, and we will honor that).
You are responsible for ensuring the materials you provide do not infringe anyone else's rights and do not contain unlawful, deceptive, or defamatory content. If a third party claims that content you supplied infringes their rights, that claim is your responsibility, and we may remove the content from the site while it is resolved.
Intellectual Property and Site Ownership
Your domain name is yours, registered in your name, and stays yours whether or not you remain a client. The content you provided remains yours as described above.
The design, code, templates, and tooling we create or use to build and run your site are part of our service platform.

Billing and Payment
The Service costs $250 per month, billed monthly in advance to the payment method on file. Prices do not include third-party charges such as your domain registration fees or your Google Workspace subscription, which their providers bill to you directly.
If a payment fails, we will notify you and retry. If payment remains outstanding after reasonable notice, we may suspend the Service, including taking the site offline, until the account is brought current.
We may change our pricing with at least 30 days' written notice. A price change never applies retroactively — it takes effect at your next billing cycle after the notice period.
There is no setup fee.
Cancellation
The Service is month-to-month. You may cancel at any time, effective at the end of the current billing period, with no cancellation fee. When the subscription ends, hosting for the site ends with it, since hosting is part of the monthly service.
Regardless of the final cancellation policy: your domain name always remains yours, your Google Workspace account always remains yours, and we will cooperate reasonably in transferring DNS or email settings so your email keeps working after you leave.
Scope of Ongoing Edits
Your subscription includes ongoing edits and support for your site: content updates, new photos, new and updated pages, and periodic redesigns as your business changes, at no additional charge.
Requests are handled in the order they arrive; larger pieces of work, such as a redesign, are scheduled with you so expectations are clear.
Third-Party Services
Parts of the Service depend on third parties: our hosting runs on infrastructure providers, your email runs on Google Workspace, and your domain is held by your registrar. These providers bill you directly where noted (Google Workspace subscription, domain registration and renewal fees) and operate under their own terms of service.
We choose reliable, widely used providers, but we do not control them. We are not responsible for outages, changes, or price increases on their side, though we will help you work through any issues they cause and, where practical, propose alternatives.
No Guarantees of Results
We build sites properly — fast, mobile-friendly, with sound on-page SEO — because that gives you the best chance of being found. But we do not and cannot promise specific outcomes. We make no guarantee of particular search engine rankings, website traffic levels, lead volume, or revenue. Search results depend on factors outside anyone's control, including competition, your market, and search engines' own algorithms. Anyone who guarantees you a #1 ranking is not being honest with you.
Service Availability
We aim to keep your site online continuously and use professional hosting infrastructure to do so. However, no host can promise 100% uptime, and brief interruptions can occur due to maintenance, infrastructure provider issues, or events outside our control. We will work to restore any interruption promptly.
Disclaimer of Warranties
Except as expressly stated in these Terms, the Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In plain English: we promise to do skilled, professional work as described in these Terms, but we do not make legal warranties beyond that.
Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claims arising out of or relating to the Service, in aggregate, will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.
We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost business opportunities, even if we were advised such damages were possible.
Some states do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold us harmless from claims, damages, and reasonable expenses (including attorneys' fees) arising from content or materials you provided, your violation of these Terms, or your violation of any law or third-party right in connection with your business or your site. This is the standard counterpart to us publishing content that only you can verify.
Governing Law and Disputes
These Terms are governed by the laws of the State of [CONFIRM before launch: state], without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located there.
Before either of us files anything, we agree to try to resolve any dispute informally first: contact us, describe the issue, and give us 30 days to work it out with you. Most problems are fixable with a conversation.
Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the effective date at the top. For material changes affecting active subscribers, we will give you notice by email at least 30 days before the change takes effect. Continuing to use the Service after a change takes effect means the updated Terms apply; if you do not agree to a change, you may cancel before it takes effect.
